Community and safety rules
Last updated: draft
Vistamigo is a place to save the places you love and share them with people you choose. These rules keep it safe and respectful. They're part of our Terms of use, and they apply to everything you add to Vistamigo: lists, notes, names you give places, and your profile.
Vistamigo is run by Warner Management Group LLC, 1323 SE 17th St. #1043, Fort Lauderdale, FL 33316, USA.
What's not allowed
Don't use Vistamigo to:
- Track, locate or monitor another person, or save someone else's home or other private places, or information about them, without their permission.
- Share someone's private information, such as their home address, phone number or where they'll be, without their permission.
- Harass, threaten, bully or intimidate anyone, or encourage others to.
- Share content that sexualises children or puts a child at risk. We have zero tolerance for this (see "Child safety" below).
- Share illegal content or help anyone break the law.
- Promote hatred or violence against people because of who they are.
- Pretend to be someone else, or suggest you're connected with someone or something when you're not.
- Send spam, run scams or spread malware, or use Vistamigo to advertise.
- Use other people's content without the right to, such as copyrighted material.
- Interfere with Vistamigo: probing for weaknesses, scraping, automated sign-ups or overloading the service.
The full list is in our Terms of use, under "Acceptable use".
How moderation works
Your lists and notes are private unless you share them, and we don't read or scan your private content. We act when something is reported to us, or when the law requires it.
When a report comes in, a person on our team reviews it, usually within 24 hours. We don't use automated tools to decide on reports or to remove content. Depending on what we find, we may:
- take no action, if it doesn't break these rules or the law;
- remove the content, or make it unavailable in some countries if it's only illegal there;
- limit what an account can do, or suspend or close it, especially for serious or repeated problems;
- report it to the authorities, where the law requires it or someone's safety is at risk.
We decide fairly and proportionately, considering how serious the problem is, whether it was intentional, and the rights of everyone involved, including freedom of expression.
Child safety
We do not allow child sexual abuse material (CSAM), or any content or behaviour that sexualises, grooms, exploits or endangers children. Vistamigo is for people aged 16 and older.
When we find or are told about such content, we remove it, close the account, and report it to the authorities as the law requires, including the U.S. National Center for Missing & Exploited Children (NCMEC) and, where relevant, the police in the country concerned.
If a child is in immediate danger, contact the police or emergency services first. To report child-safety concerns to us, use Report in the app (choose "A child's safety") or email safety@vistamigo.com. Our child-safety contact is Randy Warner, at that address.
How to report something
In the app: open the shared list or the person's profile, tap Report, choose a reason and add anything we should know. The person you report isn't told who reported them.
By email, including if you don't use Vistamigo: write to safety@vistamigo.com. To report illegal content, please include:
- why you believe it's illegal;
- where it is, as precisely as you can (for example, the list's name and its owner's @handle);
- your name and email address (not required for reports of child sexual abuse material);
- a statement that you believe, in good faith, that your report is accurate and complete.
We'll confirm we've received your report, and tell you what we decided and why.
If we take action on your content or account
We'll tell you what we did and why: which content or account, the rule or law involved, the facts we relied on, and how to challenge the decision. We won't do this where the law or an authority tells us not to, or where it would put someone at risk.
How to challenge a decision
If you disagree with a decision we made, about your content or account, or about something you reported, reply to our email or write to safety@vistamigo.com within six months. A person who wasn't involved in the original decision, where possible, will review it and reply. If we got it wrong, we'll reverse it.
If you're in the EU, you can also take the dispute to a certified out-of-court dispute settlement body, and you can always go to court or to your national authority.
Misuse of reporting
If someone keeps sending reports that are clearly unfounded, we may stop processing their reports for a while, after a warning. If an account keeps sharing clearly illegal content, we'll suspend it.
Blocking
You can block anyone you've connected with or share a list with. Blocking ends the connection, takes you both off each other's lists, and stops them seeing your profile or contacting you. They aren't told. You can unblock them in Profile.
Contact points
For users and for authorities in the EU and elsewhere, our single point of contact for safety, content and legal requests is safety@vistamigo.com. You can write in English or Spanish. For anything else, write to hello@vistamigo.com.
Changes
We'll update these rules as Vistamigo grows. If we make significant changes, we'll tell you in the app or by email before they take effect.
